Mobilization is ongoing in Ukraine, which may soon change due to a significant innovation – the Cabinet of Ministers, by its resolution No. 981, has instructed the State Tax Service to carry out a one-time transfer of data to the Ministry of Defense regarding all citizens of Ukraine aged 18 to 60, whose information is subject to entry into the Unified State Register of conscripts, reservists, and persons liable for military service.

According to lawyers specializing in, among other things, mobilization legislation, the Ministry of Defense and TCAs will receive information about the identification numbers of men aged 18 to 60.

What opportunities does the transfer of such codes open up for TCAs – lawyers Maryna Bekalo and Andriy Mezhyrytskyi shared their views on the situation in a commentary for TSN.ua.

“The issue is that the information contained in the Demographic Register is not always up-to-date,” says Maryna Bekalo.

She explains: “The Ministry of Defense and, in particular, TCAs sometimes have outdated data on reservists. I analyzed the situation, and in my opinion, the answer to the question of why the Ministry of Defense needs to know a person’s tax number is that it allows them to find out their place of registration. Tax authorities have more information, and this concerns self-employed individuals (FOPs) more than employed workers. Regarding employed reservists, the employer is obliged to provide the necessary information. And FOPs conduct their activities at their place of registration. I believe that this innovation opens up more opportunities to find FOPs. TCAs will receive more information about reservists. Existing and new information will be verified, and a summons may be sent to the current address. If a person is wanted, this data is transferred to the police for further detention.”

According to Maryna Bekalo, this also provides more opportunities to monitor Ukrainian men who are abroad.

“Currently, many men are seeking consular services and help with passport-related issues. The innovation offers more ways to find out where a man is. What for? Physically and legally, it is currently impossible to bring a man from abroad against his will. If they wish, TCAs can find out where a specific Ukrainian is located abroad. It is worth noting that when a Ukrainian applies to a consulate, among other things, they are obliged to report their registration in the country of stay. Under the new rules, embassies can transfer this information to the Ministry of Defense,” she says.

Mobilization of men without a tax identification number: details

According to current legislation, a person may not have an identification code, for example, due to their religious beliefs.

“There are not many such people; for instance, from my own practice, I know one such man, he hasn’t turned 30 yet. When he was detained by TCA representatives, they could not carry out mobilization actions because he did not have an identification code,” Maryna Bekalo told us.

She noted that in the absence of an identification code, there is a special note in such a person’s documents.

“This does not prevent such a person, for example, from opening a FOP. In such a case, there will be a note in the documents that the code is missing for religious reasons. This information is also available to tax authorities. This does not prevent identification of the person by other means. And to find them if necessary,” the lawyer concluded.

Mobilization in Ukraine: those who haven’t been seen will be registered for military service.

In turn, lawyer Andriy Mezhyrytskyi expressed the following opinion: “This innovation will help identify the remaining reservists who were not registered. And they will be registered. There is currently a rule under which a person is automatically registered if information about them is available in the TCAs. The tax service registry is considered the most comprehensive, although I personally believe that the voter registry is the most comprehensive, and it has long been processed. Therefore, a comparison of the information contained in ‘Oberih’ and that received from tax authorities will occur. That is, a certain number of individuals will be added to ‘Oberih’, and they may be declared wanted.”

Regarding individuals who do not have an identification code, he says the following: “In the mid-2000s, there was a phenomenon where many people, hundreds of thousands, refused this code through courts. These were mainly elderly people. I think there are not very many such people now. But information about them is also contained, just with their passport number. I think this information will also be transferred,” says Andriy Mezhyrytskyi.

We remind you that earlier it was reported that the rules for obtaining deferment have changed in Ukraine. The government has changed the procedure for issuing and reissuing deferments, the Ministry of Defense is preparing a reform of TCAs, and the Center for Countering Disinformation has refuted information about alleged new restrictions on the right to deferment.
